Foreclosure Overview

A foreclosure is when a mortgage holder attempts to take ownership of a home to secure payment of the loan used to purchase it. Foreclosures are complex and many protections exist for homeowners.

Foreclosure Defense

Many times creditors will attempt to take shortcuts in the process. Other times predatory lenders may claim false facts. Either one when properly challenge, can result in the foreclosure being dismissed.

Foreclosure Motions

Many foreclosures are won or lost on motion practice. Creditors routinely use summary judgment motions to resolve foreclosures. Improperly responding to a motion, or failing to make your own, can often waive key defenses.

Foreclosure Appeals

A foreclosure appeal seeks to have an appeals court review the trial court's determination on the case. Thorough knowledge of foreclosure defenses, and how to present them to the appellate court is the key to foreclosure appeals.
