PINS Proceedings in Family Court

Article 7 of the Family Court Act authorizes the Family Court to have PINS proceedings. PINS is an acronym for Persons In Need of Supervision.

When a child fails to obey his parents to such a degree that he is endangering himself or others, the parents may seek to have the child placed in a secure facility or obtain other help.

A lawyer will be assigned to represent the child. Parents also have the right to an attorney. Many PINS cases are resolved through referring the family to various resources to assist them.

What is a PINS Proceeding?

A PINS proceeding is filed when the child does not obey his parents, fails to attend school, or is otherwise out of control.

Who may file a PINS petition?

The child's parents, the police, someone the child injured, by a school or by an authorized agency.

What is the Fact Finding hearing?

The fact finding hearing is a hearing where the party filing the PINS petition presents evidence about the child's behavior. The child is entitled to representation and may defend against the claims. The Family Court judge will decide if the claims in the petition have been established.

What is the Dispositional Hearing?

The dispositional hearing is where the judge decides if the child is in need of supervision or not. The judge may dismiss the entire proceeding, or order the child be placed in a secure facility.
