Relocating with a child when you have custody is not automatic.  Even though there is a custody order in place, there are restrictions on moving if they interfere with the other parent's time with the child. If you want to move, you will either need the consent of the other parent or the court's permission to do so.

What constitutes a move is unique to each case; the range could be as little as 10 miles or much farther.  Whatever that distance is, if your planned move is outside that range you will need to file a relocation petition.

Why can't the parent who has custody simply relocate?

A custody order is always subject to the rights of the other parent and since a moving a significant distance would impact that parent's rights, either an agreement or a court order is needed.

What gives the court the authority to stop an adult from moving?

The court cannot stop an adult from moving as people are free to live where ever they wish. The court can change custody of a child if the custodial parent relocates improperly.

  • The terms of existing custody and parenting time order.
  • The parent’s reasons for relocating.
  • The effect the move will have on the other parent's time and the relationship between that parent and the child.
  • The effect the relocation would have on the child’s life.

  • The effect the move would have on existing relationships such as grandparents and siblings.
