When spouses have significantly different financial resources and income, the monied spouse has a legal obligation to support the non monied spouse. This obligation can be part of a divorce action, or if not divorce is pending, can be a stand alone proceeding in Family Court.
Family Court is authorized to set and fix an order of spousal support.

I'm not in a divorce, can I still get an order of spousal support?
Yes. A spouse has a legal duty to support the other spouse that is not dependent on a divorce.
How do I request an order of spousal support?
A petition is filed in Family Court to request spousal support. This request can go hand in hand with an petition seeking child support, or it can stand alone.
How long does my spouse have to support me?
If an order of support is made through the Family Court, the order lasts until it is modified or the parties divorce.
How come a Family Court order of spousal support ends if we get divorced?
Family Court has the authority to award spouses support. Once the parties are divorced, the Family Court lacks jurisdiction over support.
What if I need spousal support after I am divorced?
Any request for support after a divorce must be made as part of the divorce.
How is spousal support calculated in Family Court?
Spousal support is calculated the same was as it is in Supreme Court for a divorce, the same formula is used.
